GFGSS on bagaboo?

    It comes from when Bagaboo provided sponsorship for the Easter Weekender event. Link sharing and so on were part of the deal.
  • Whoever took the photo (rabsda?) should have had those in the photo sign a model consent form given that the image was to be used for advertising purposes and i presume you knew this when you came to polo and shot it?
    Not that i would have objected but i'd like to know which brands and products it is being insinuated i endorse.

    note it doesn't say glasgow fgss or polo on it, it doesn't identify the riders and you can only see 2 faces which are quite blurred and small really. I know what you're saying though and it's a valid point.

    However, release forms are very impractical as you wouldn't sign an open one for use in any commercial situation like if some evil bastard corp wanted to use your coupon but most of the time you don't take a photo for a commercial use, it might just end up down the line being appropriate for use.

    A more practical (and in keeping with the group's current model of organisation) solution might be that if one of your photos is going to be used in an advert or commercial sense other than to promote the forum or polo... then you should post a thread on here about it and give it a few days for objections from the models.

    I'm glad you posted on this thread Sean and i apologise for including your name in the discussion as it was 3rd hand info that i heard that it was you that took the photo.
    I'd like to reitterate that i feel Bagaboo and not the photographer are/should have been responsible for ensuring that everyone in this image (whether pictured facially or otherwise) consented to their image being used to endorse the brand.
    If you look at photo libraries as an example, a lot of them will not accept recognisable images of people unless a release form from the people in the image is included.
    I understand that the image was posted/hosted on a pool related to the forum and that access to this pool was part of the deal when Bagaboo provided sponsorship but that is a deal between Rusty as forum owner/head admin of the forum and Bagaboo, not the people pictured or even the author of the image.
    Perhaps i'm making assumptions but i'd say that noone in that image would object to being used to endorse Bagaboo's products but it might be a different story if the image had appeared in an article in a publication aimed at a homosexual audience for example.
    I'm going to guess that whoever dealt with Bagaboo made that same assumption, perhaps in ignorance of laws/general practice regarding advertising images. (please note this does not bother me, i have no beef with whoever this applies to as Bagaboo should really have asked about consent.)
    As for your suggestion about making a post if any of your images are to be used in a commercial way, i'd say that is fine but that the author of the image really needs to look at how their image is to be used and consider whether posts on a thread on the internet made by people using aliases are really adequate.
    I personally certainly would not be happy selling an image i took of any of you without signed release forms.
    I'd also ask/suggest that this 'condition of image use' was extended to those in control of flickr accounts/pools etc that may feature images not taken by themselves.

  • I'm too busy to read all of MVs post but just thought I'd say, I have no agreement with Bagaboo. Rabsda contacted Bagaboo to ask for prized. He replied saying 'sure' and as a courtesy he put our link on the bagaboo website. Some photos have been put on the Bagaboo website including some photos from the glasgowfgss pool on flickr. Fixed gear is one big family.
  • The guy from bagaboo asked for some photos of the weekender cause obviously he wanted to see that it happened as he'd given quite a few prizes etc and i pointed him to the flickr pool to see them. He then asked if he could use the polo one as a banner image and i spoke to phunkymunky who said aye cool. So that's how it came about to be on the site. to be honest i didn't really think about release forms etc, i probably should have but...

  • i think it is a valid thing to bring up. I don't think there was any foul play on this occasion given the photo and the use but it's worth bringing up stuff like this so it's out there for future. If coca cola came calling?

  • Och look, perhaps i coulda been a bit more tactful in the way i brought it up but i reckon this thread has brought about some much needed discussion that is going to end up being for the general good of the forum and everyone who uses it.
    We can all see how fixed gear culture is being grabbed at by everyone who reckons they can make a quick buck out of it or punt a few units of merchandise by relating themselves to it. If that trend continues then it'll not be long before it's gone from a friendly part of the fixed gear family taking the opportunity of a free banner image and escalated to a national or international company - who sell t shirts made in sweat shops or veal steaks or whatever pisses you off - being given an inch and taking a mile where usage of media is regarded.

    I can see how my 1st post could be taken as being fairly inflammatory so i'd like to say that as i have learned more of how the image got there i have become aware that noone here was at fault, and i am now just quite stunned that Bagaboo have been happy to use an image on their website without having release forms from those in it. It seems like they are really leaving themselves open for a lot of trouble.

  • Rose Veal is veal minus the confined spaces so you can be a little less worried about the poor dairy calves that would be slaughtered regardless as they are essentially waste from dairy farming.
